International trademark registration

First, we would like to draw your attention to the fact that the certificate of registration of a trademark obtained in one country, your native counrty, for example, provides legal protection only in the territory of that country.

If you do business in other countries, export your goods abroad or just intend to expand the boundaries of your activities, it will be extremely necessary to protect your interests by obtaining a trademark protection in the countries you are interested in.

Regimark will be happy to provide you with a full range of trademark registration services in any country or group of countries of your interest. We will do all the work on the preparation and filing of the application and the subsequent receipt of the certificate in the countries you have chosen. We also may perform any necessaery actions, such as assignmennt of rights, renewal of a trademark, etc.

Our professionalism and long-term experience in filing international and national applications in cooperation with patent attorneys from other foreign countries allows us to successfully represent your interests outside of native country.Having our own offices in Riga and Moscow allows us to provide our clients with additional advantages for registration in European Union, Russia and other Eastern European countries.

The protection of intellectual property rights for trademarks abroad can be carried out either by filing national applications in each selected country or by filing an international application specifying several countries with subsequent legal protection in these countries.

At present, if you want to obtain legal protection for a trademark abroad, you have three options:

Registration of a trademark at the national patent office of each selected country

Registrationis carried out by applying an application to the national authorities of the selected countries with subsequent registration and issuance of a certificate in accordance with the country procedure. It is cost-effective in the event you want to register your trademark in a small number of countries (1-3 countries) or if the countries of your interest do not belong to the Madrid System.

Registration in EU countries (European Union trade mark)

This procedure is economically justified if registration is needed in more than 2 European countries. However, it should be noted that the registration of the trademark under the Madrid system also provides legal protection of the trademark in the EU countries. International registration of a trademark under the Madrid System.

In accordance with the Madrid System, an application for the international registration of a trademark can be filed only if there is a national registration / application. An application for the international registration of a trademark is submitted to the International Bureau of the World Intellectual Property Organization (WIPO), which makes it possible to provide legal protection simultaneously in several countries by filing one international application (list of countries). In this case, the list of countries in which the applicant seeks legal protection is indicated in the international application. This system significantly simplifies the procedure of obtaining legal protection and further management of rights of a trademark, because any changes are made only in the materials of the international application, including the renewal of the protection document. The registration of a trademark under the Madrid System reduces the number of formal requirements and incurs lower costs.

Regimark guarantees the confidentiality of all information received in the course of processing a trademark registration.

Prior to submitting an application for registration, it is recommended to conduct a search for identical or similar trademarks among registered and filed for registration trademarks in the territory of the intended country.

There are open search engines by which it is possible to search and verify a trademark according to certain criteria. Such an independent search gives an idea of the situation what trademarks are already registered and used in this field of activity, or, if there are several versions of the designation, then such a search will help to exclude clearly inappropriate designations. Such search service may be found at the following link.

Before applying for a new trademark registration, it is essential to make sure that it is possible to register this trademark and that it is free to use it. We examine a trademark for absolute grounds of refusal and search relevant databases for identical marks among EU trademarks, EU national trademarks and international trademarks designating the EU or EU member states. Based on this search and our analysis, we provide a professional opinion on whether your trademark is registrable in the European Union and you may proceed with the registration process, or whether there are evident obstacles to registration of your trademark that exist, and a more thorough analysis needs to be performed.
